May 20, 2008, Toronto, Ont. – The Union of Food and Commercial Workers (UFCW) Canada is back in court today.

May 20, 2008, Toronto, Ont. – The Union of Food and Commercial Workers (UFCW) Canada is back in court today.

The Ontario Court of Appeal in Toronto is hearing argument from the union May 20 and 21, 2008, claiming that the exclusion of Ontario agricultural workers from unionizing is unconstitutional.

The application, brought by UFCW Canada and three Ontario agriculture workers, argues Ontario's Agricultural Employees Protection Act (AEPA), which denies Ontario agriculture workers the right to unionize and bargain collectively, is a breach of those workers' constitutional rights under the Charter of Rights and Freedoms.

Responding to the appeal is the Attorney General of Ontario. The Ontario Federation of Agricultural is also an intervenor.
